PTI challenges the constitutionality of military courts and army deployment in SC.

-

The Pakistan Tehreek-e-Insaf (PTI) has filed a petition in the Supreme Court (SC) challenging the constitutionality of trials in military courts and the deployment of armed forces in the Supreme Court.

The petition was filed by PTI’s lawyer Babar Awan on Tuesday. He argued that the trials in military courts are a violation of the Constitution and that the deployment of armed forces is unnecessary and unconstitutional.

Awan said that the Constitution gives the judiciary the sole power to try civilians. He said that the establishment of military courts is a violation of the separation of powers.

Awan also said that the deployment of armed forces in the country is unnecessary and unconstitutional. He said that the government has failed to provide any evidence to justify the deployment of armed forces.

The petition has been filed under Article 184(3) of the Constitution, which allows the SC to take suo motu notice of any matter that it deems to be of public importance.

The SC is expected to hear the petition soon.

The PTI’s move comes after the government extended the tenure of military courts by another two years. The government had initially established military courts in 2015 to try civilians accused of terrorism.

The extension of the tenure of military courts has been criticized by human rights groups, who say that the courts are a violation of the rule of law. They also say that the courts have been used to target political opponents of the government.

The PTI’s petition is likely to add to the political turmoil in Pakistan. The country is already facing a number of challenges, including a weak economy, a growing security threat, and political instability.

The PTI’s petition is a challenge to the government’s authority. It is also a test of the SC’s willingness to uphold the Constitution.

Here are some reactions to the PTI’s petition:

  • Human rights groups have welcomed the PTI’s petition, saying that it is a step in the right direction to uphold the rule of law.
  • The government has defended the establishment of military courts, saying that they are necessary to fight terrorism.
  • The SC has not yet commented on the PTI’s petition.

The PTI’s petition is a significant development in Pakistan’s political landscape. It remains to be seen how the SC will rule on the petition.
